Going by the news reports, the Attoreny-General Mukul Rohatgi has advised Governor ESL Narasimhan to send a notice of Section 8 of AP Reorganisation Act to Telangana CM KCR. Mr Mukul apparently told Governor to send a draft notification of Section 8 to KCR and asked him to take KCR’s views on it.
In his letter to Governor, Mr Mukul said that if the Telangana CM failed to respond, the Governor may issue the notification of Section 8 on his own. He stated that Governor might give three days time for Telangana government to respond and that too as per Governor’s discretion.
The A-G wrote, “Firstly, the notification which you wish to issue under Section 8 of the AP Reorganisation Act must be preceded by consultation with the council of ministers of the state of Telangana. You may send the draft notification to the CM of Telangana and ask for his views. You may, in your discretion give three days to respond, where after you may issue the notification as per your discretion. If valuable comments are received from the Chief Minister, you may incorporate the same in the notification, but the final word is that of the Governor.”
He further added,”The draft of the notification may be prepared by your advisers. You may take care to direct not only the officers and employees of Government of Telangana, but you may direct the government itself.” The Attoreny-General clearly told Narasimhan that Governor’s word would be final in this respect.
With this, it’s likely that Section 8 would come into force. It needs to be seen how the Telangana government is going to tackle the issue now. Let’s wait and watch.
